Our VerdictsMr. Stephen’s Jury Verdict in Markham

Joel Stephen tried a case to verdict in Markham from September 29 to October 1, 2014. The case number was 2012 M6 2311, Sobota v. Lio Food Distributors, etal. On August 22, 2011, the defendant’s employee rear ended Ms. Sobota while she was stopped for a red light. She filed her lawsuit contending that she suffered chronic injuries to her neck muscles and and injury to the C4-C5 disk of neck and a disk to her lumbar spine. Ms. Sobota and her counsel put in evidence to the jury $17,000 in medical bills and $47,000 in wage loss to the jury. Her counsel asked the jury to award $180,000. Mr. Stephen, representing Lio Food and its driver, persuaded the jury, based on his meticulous discovery work, that Ms. Sobota’s disk pathologies were unrelated to the accident and that her time off from work as a full time nursing assistant for Our Lady of Victory and as a part time medical assistant for the Fransican Nuns was excessive.
